The term "user" includes all customers and visitors of our online offer. Used terms, such as "user" shall be neutral in gender.
 

1. Basic information on data processing

We process personal data of users subject to relevant data protection regulations according to the requirements of data economy and data avoidance. This means that user data is only processed in case of a legal allowance, especially when the data is necessary to fulfill our contractual performances such as online services or when they are required by law or when an authorization has been obtained.
 
We take organizational, contractual and technical safety measures according to the highest level of current technology to ensure that regulations of the data protection act are adhered to and to protect the data processed by us against accidental or deliberate manipulations, loss, destruction or access by unauthorized persons.
 
For the purposes of this privacy statement, if contents, tools or other means of other providers (herein-after called "third party providers") are used within the scope of this data privacy statement and if the location they indicate is abroad, it must be assumed that data transfer to member states of the third party providers will take place. Transfer of data to non-member states is made either on basis of a legal permission, consent of the user or special contract provisions, ensuring a legally assumed data safety.

2. Processing of personal data

Aside from the use explicitly stated in the data privacy statement, personal data is processed for the following purposes based on the legal permissions or contents of the users:
  • Provisioning, execution, administration, optimization and protection of our service and user performances;
  • Warranty of an effective customer service and technical support.
 
We only transfer user data to third parties if necessary for settlement purposes (e.g. to a payment provider) or for other purposes if necessary to fulfill our contractual obligations with respect to the users (e.g. transfer of addresses to the supplier).
When contacting us (through the contact form or email), the user data is saved for the purpose of processing the inquiry as well as for potential follow-up questions.
Personal data is deleted once it fulfilled its purpose and no retention obligations prevent the deletion.

3. Collection of access data

With every user access to a website and with every file opened, access data about this procedure is saved in a log file on the server of our ESTUGO.net provider.
 
Every data record consists of:
•             The site which opened the file including possibly used search terms
•             The name of the website or the file
•             Date and time of the access
•             The data rates transmitted
•             The access status (file transmitted, file not found etc.)
•             A description of the type of the web browser used as well as the operating system
•             The country or the domain or organization from which the access is made (TLD)
•             Client IP address, decoded via DNS look-ups
 
We use the logged data, without identifying the user or other profile settings according to the legal regulations, only for statistical evaluation for the purpose of the operation, safety and optimization of our online offer. However, we reserve the right to subsequently check logged data in case of justified suspicion based on concrete evidence for illegal use.
 

4. Cookies & reach measurement

Cookies transfer information from our web servers or web servers of third parties to the user web browser, which are saved to revisit at a later time. The privacy statement informs the users about the use of cookies for pseudonymous reach measurements. The legal basis for this is contained in Art. 6, para. 1, sentence 1(f) GDPR.
 
The online offer can also be visited while excluding cookies. If the users do not wish to have cookies saved on their computer, they are asked to deactivate the respective option in the system settings of their browsers. Saved cookies can be cleared in the browser system settings. The exclusion of cookies can lead to functional restrictions of this online offer.

6. Google Analytics

We work with Google Analytics, a web analytics service of Google Inc. ("Google").
 
Google Analytics uses so-called “cookies“, text files, which are saved on your computer and which allow an analysis of the use of this website by you.
The information generated through cookies about your use of the website, such as
  • Browser type/version
  • Used operating system
  • Referrer URL (the web site visited before)
  • Host name of the computer taking access (IP address)
  • Time of the server inquiry
are generally transmitted to a Google server in the US and are saved there.
 
Google will use this information on our behalf in order to evaluate the use of our online offer by the users to gather reports about the activities within this online offer and to offer further services based upon the use of this online offer and the internet use of the related service providers. The processed data could be used to generate pseudonymous user profiles of the users.
 
These purposes also include our legitimate interest in data processing. The legal basis for the use of Google Analytics is § 15 par. 3 TMG or art. 6 par. 1 lit. f DSGVO. The data sent by us and linked to cookies, user name (e.g. User ID) or data linked to competitive IDs is automatically cleared after 14 months. The clearing of data where the retention period has elapsed automatically happens once a month.
 
We use Google Analytics only with activated IP anonymization. This means that the IP address of the user is shortened by Google within member states of the European Union or other contracting states to the Agreement on the European Economic Area. Only in exceptional cases the full IP address is transmitted to a Google server in the USA and is shortened there.
 
The IP address transferred by the user browser is not combined by Google with other data. The users can avoid storage of cookies by a respective setting of their browser software; the users can furthermore avoid the collection of the data created by cookies and related to their use of the online offer as well as the processing of this data by Google, by downloading and installing the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

Google Tag Manager
The Google Tag Manager is a solution which allows us to manage so-called website tags via an interface (and thus for example we can integrate Google Analytics as well as other Google-Marketing services into our online offer). The tag manager itself (implementing the tags) does not process any personal user data. With respect to processing personal user data, we would like to refer to the following indications with respect to the Google services. 7. Google-Re/Marketing services

We use the marketing and remarketing services (in short „Google-Marketing-Services“) of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, („Google“).
 
The Google Marketing Services allow the display of advertisement for and on our website more precisely to only present relevant advertisement to the users. If users see advertisement for products, for which they have shown interest on other websites, this is referred to as "remarketing". For this purpose, when opening our and other websites where the Google Marketing Services are active, a Google code is immediately executed by Google and so-called (re)marketing tags (invisible graphics or codes which are called "web beacons") are incorporated into the website. With the tags an individual cookie, i.e. a small file is saved on the device of the user (comparable technologies to cookies are also possible). Cookies can be set by various domains, among others by google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. This file logs which websites the user visits, the contents which are relevant to the user and which offers the user clicked on, as well as technical information about the browser and the operating system, linking websites, visiting time and other indications about the use of the online offer. Besides, the IP user address is detected and we forward information within the scope of Google Analytics, that the IP address is shortened in the member state of the European Unions or in other member state of the European Union and is only in some exceptional cases completely transmitted to a Google server in the USA and is shortened there.  The IP address is not combined with data within other Google services. The information indicated above can also be connected to such information from other sources. When the user visits other websites afterwards, advertisement matching the user’s interests will be displayed.
 
The user data are processed under a pseudonym within the scope of the Google Marketing Services. Google does not only save and process for example the name or the email address of the user, but processes the relevant data cookie-related within pseudonymous user profiles. This means that from the Google point of view, not only advertisement for specifically identified users are managed or displayed, but for the cookie owner, independently from the fact to whom the cookie belongs. This does not apply when a user has given the express permission to Google to process the data without pseudonymization.  The information about "DoubleClick" collected by the user is transmitted to Google and is saved on the Google servers in the US.
 
The Google Marketing Services we use include among other things the online advertising program "Google Ads". In case of Google Ads, every Ad Customer gets another "Conversion Cookie". Cookies cannot be tracked via the websites of Ads customers. The information gathered by the Conversion Cookies is used to create conversion statistics for Ads customers, which have decided for conversion tracking. The Ads customers are informed about the overall number of users who clicked on this ad and who are forwarded to the website incorporating a conversion tracking tag. However, you do not receive any information, by which the user could be personally identified.
 
Based on the Google Marketing Services "DoubleClick" we should like to integrate advertisements of Third Parties. DoubleClick uses Cookies, by means of which Google and the related partner web sites allow to launch advertisements based on the visits of customers on this web site or other web sites in the internet.
 
Based on the Google Marketing Services "AdSense", we integrate advertisement of third parties. AdSense uses Cookies with which Google and related partner websites allow to launch advertisement based on visits of customers to this website or other websites on the Internet.
 
Another Google Marketing Service we use is the "Google Tag Manager" with which further Google analysis and marketing services can be incorporated into our website (e.g. "Ads", "DoubleClick" or "Google Analytics").

Google Ads
 
Our website uses the Google Conversion Tracking. If you were directed to our website via a Google advertisement, a Cookie will be set on your computer by Google Ads. The Cookie for the Conversion Tracking is set when a user clicks on advertisement launched by Google. These Cookies expire after 30 days and do not hold any personal identification. When the user visits certain pages on our website and the cookie has not yet expired, we and Google can see that the user has clicked on the advertisement and was forwarded to this website. Every Google Ads customer receives a different Cookie. This way Cookies cannot be tracked via the websites of Ads customers. The information gathered with the Conversion Cookies are used to create Conversion statistics for Ads customers who decided upon conversion tracking. The customers are informed about the overall number of users who have clicked on this ad and who are forwarded to the website incorporating a conversion tracking tag. However, you do not receive any information by which the user could be personally identified.
If you do not want to participate in tracking, you can reject selection of the respective cookie - e.g. by browser setting, which generally deactivates Cookies or you can adjust your browser in a way that the Cookies are blocked by the domain "googleleadservices.com".
 
Please note that you are not allowed to clear the Opt-out Cookies as long as you do no wish that your measuring data are recorded. When you have cleared all your Cookies in the browser, you have to re-set the respective Opt-out Cookie.

8. Integration of services and contents of third parties

Contents and services of third party providers can be incorporated within our online offer, such as city maps or fonts of other websites. Incorporation of contents of third party providers is always based on the prerequisite that the third party providers receive the IP address of the user, as they cannot send the contents to the browser of the user without the IP address. For this reason the IP address is required for representation of these contents. Furthermore, the providers of third party contents can set their own cookies and use the data of the users for their own purposes. The processed data could be used to generate user profiles of the users. We are going to use these contents with respect to data-economy and data-avoidance and are going to select reliable third-party providers.
 
The following representation offers an overview of third party providers as well as their contents and links to data privacy statements, including further hints on data processing and – as partially already mentioned here – so-called possibilities for objection (so-called Opt-Outs):

 9. User rights and data clearing

Users are entitled to get information about personal data saved by us for free.
In addition, the users are entitled to correct data, cancel authorizations, block and clear their personal data as well as the right to submit a complaint to the respective authority in case of acceptance of an illegal data processing.
 
The data saved by us clears as soon as no longer needed for their initial purpose and if data clearing is not subject to any legal storing obligations.

10. Modifications of the privacy statement

We reserve the right to change the data privacy statement in order to adapt it to the changed legal status or in the case of changes of the provider or data processing. This is however only valid with respect to declarations about data processing. Should user consent be necessary or should they be part of data privacy regulations of the contract with the users, these changes can only be executed with the consent of the users.
Users are asked to regularly review the most recent content of the data privacy statement.
